Court rulings are never absolute, and legal decisions often reflect clashing contentions. The Supreme Court's decision in 303 Creative LLC v. Elenis (2023) highlights these tensions, particularly concerning the freedom of speech and businesses' right to refuse service. I argue that companies should have the right to refuse service only when they meet two conditions: when a public statement infringes upon the company's legal personhood and when the First Amendment guarantees equal engagement and legal protection of social minorities.
Legal personhood, a crucial concept that recognizes companies as entities with specific rights, reflects the collective values of their workers and owners. This legal recognition carries significant weight, justifying a company's refusal of business when its principles are at stake. In the 303 Creative LLC case, the court's ruling that requiring service to queer couples infringed on the web designer's First Amendment rights was a powerful acknowledgment of her business's legal personhood.
However, the protection of social minorities often remains conditional. The Masterpiece Cakeshop v. Colorado Civil Rights Commission (2018) case illustrates the conflict between religious freedom and anti-discrimination laws, where the Supreme Court sided with religious freedom, questioning whether this neutrality truly protected minorities.
The right to refuse business, when used judiciously, can be a powerful tool for minority groups to engage in social discourse. For instance, a restaurant owner's refusal of service to Sarah Sanders in 2018 based on political beliefs is a clear demonstration of how businesses can uphold their principles while promoting public engagement. Such cases underscore the need to balance businesses' right to refuse service with the imperative to protect social minorities, ensuring that legal frameworks foster equitable participation in society. Prioritizing the First Amendment should not neglect anti-discrimination efforts but ensure that businesses safeguard autonomy and individual rights.
