This year marks the 30th anniversary of Korea's legal obligation to protect refugees in the international community by joining the Convention on Refugee Status. It is also the 10th anniversary of the enactment of the Refugee Act. 

However, the reality of refugees in Korea is still disastrous. According to the Nansen (Refugee Human Rights Center), only 1% of refugee applicants in Korea were accepted as refugees in 2021. Also, the social awareness of refugees is still negative. A joint survey conducted in January with the United Nations Refugee Agency (UNHCR) and Korea Research showed that 33 percent of adult men and women voted in favor of accepting refugees, and 53 percent opposed it. 

Despite these conditions, the Ministry of Justice has defined refugee reapplicants as 'abusive refugee applicants' who apply for a stay. Therefore, they are not allowed to extend their stay. Moreover, the Ministry of Justice is ordering them to leave the country with a grace period of three to six months, making them hard even to continue their basic life.

On June 20, World Refugee Day, the NHRC(National Human Rights Commission of Korea) issued a statement emphasizing the guarantee of the right to live for refugee applicants. The NHRC argued that "Imposing restrictions on reapplicants not only unfulfilled the state's responsibility but also can violate the principle of prohibition of forced repatriation."

Currently, interest in refugees has increased more than ever in Korea due to the issue of the pros and cons of accepting Ukrainian refugees. However, the Korean government has yet had a practical solution. Since the refugee issue is emerging internationally more than ever, the Korean government should actively deal with the refugee issue: it is not a burden to neglect, but a problem to be discussed quickly.

올해는 한국이 난민 지위 협약에 가입해 국제사회에서 난민을 보호해야 할 법적 의무가 생긴 지 30주년이 되는 해다. 난민법이 제정된 지 10주년이 되는 해이기도 하다. 

그러나 한국의 난민 현실은 여전히 비참하다. 난센(난민인권센터)에 따르면 2021년 국내 난민 신청자 중 난민으로 수용된 비율은 1%에 불과했다. 또한, 난민에 대한 사회적 인식은 여전히 부정적이다. 지난 1월 유엔난민기구와 코리아리서치가 실시한 공동조사에 참여한 성인 남녀의 33%가 난민 수용에 찬성했고 53%가 반대했다. 

이런 여건에도 법무부는 난민 재신청자를 체류신청을 하는 '남용적 난민신청자'로 규정했고, 그들에게 3~6개월의 유예기간을 두고 출국명령을 내려 재신청자들은 그 기간 동안 기본적인 생활의 영위도 어려운 상황이다. 

세계 난민의 날인 6월 20일, 국가인권위원회는 난민 신청자들의 생존권 보장을 강조하는 성명을 발표했다. 인권위는 "재신청자를 제한하는 것은 국가의 책임을 다하지 못하는 것일 뿐만 아니라 강제송환 금지 원칙을 위반할 수 있다"고 주장했다.

현재 국내에서는 우크라이나 난민 수용에 대한 찬반 논란이 불거지면서 난민에 대한 관심이 어느 때보다 높아지고 있다. 그러나 한국 정부는 아직 실질적인 해결책을 내놓지 못하고 있다. 난민 문제가 어느 때보다 국제적으로 대두되고 있는 만큼 한국 정부는 적극적으로 난민 문제에 대처해야 한다. 난민 문제는 옆으로 제쳐둘 문제가 아닌 속히 다루어야 할 문제다.
